Effective Active Listening Skills Essay Effective active listening is a must in every communication process. Everyday, people engage in communication processes, but some fail to perform effective active listening skills. Neglecting this important aspect of communication can hamper communication. In the video clip, Planning to Promote Socially Appropriate Behavior, we see how effective active listening skills work to attain communication among the participants. Four teachers serve as participants in the video clip. They are kindergarten teachers who express the importance of teaching affective communication skills. Each teacher is given her chance to express herself to the group, while others listen intently. Notably, several factors affect the success of their communication process, among which is effective active listening. The communication takes place in the school. The teachers are seated along one edge of a long table. Although the table is long, they sit closely with each other, which makes it easy for them to hear the one speaking. This way, they did not have to raise their voices or stand to be recognized before they speak. The environment and position of the teachers notably affect the communication process. Since there is the absence of noise, we find the environment conducive to achieving communication. Obviously, the teachers have a common concept in mind of what needs to be discussed. This is very important in every communication situation. Setting a target for the group will help facilitate understanding. For instance, when holding a faculty meeting, the head should identify the agenda in advance. By doing this, concerns which are not relevant to the given topic may be avoided. Particularly in this meeting, the teachers are exchanging ideas on how to teach affective skills to students. One of the teachers expresses that most of the students she encounters do not show respect in communicating with peers. She feels that students should be taught the proper way to approach others, including their teachers. This statement serves as the lead for other participants to discuss ways on how they incorporate affective skills in their classroom. Aside from serving as the lead, this statement also limits the discussion to one single topic. As Lansberger (1996) notes, active listening requires focusing intentionally on who you are listening to in order to understand what the person is saying. This does not mean agreeing with, but rather understanding what is being said. Particularly, we can note that the teachers in the video achieve focus by speaking one by one. This makes the message come across clearly, making the flow of thought more comprehensible and organized, thus allowing for effective active listening. In the same way, this helps the audience summarize more easily the points raised. Also, according to Lansberger, active listening is present when the listener is able to repeat back in her own words what is said. This pertains to the feedback part. Before one is able to report what she listens to, there is the process of internal communication in which the person tries to â€Å"digest† the perceived ideas. For instance, when we are listening to a lecture, we sometimes hear ourselves repeat exactly what our teacher says. This is a sign that we are listening actively. In the video, we see that the teachers are able to follow the ideas of their colleagues. In addition, although they do not repeat what their colleague is saying, at one point, one teacher is able to complement the thought of the speaker. This is a sign of effective active listening, as the listener is able to construct the statement at the same time the speaker is trying to convey it. Another sign that demonstrates effective active listening is the listeners facial reaction. As one teacher speaks, we can note that others react by nodding, winking, smiling, and sometimes even bending slightly towards the speaker to hear more clearly. Moreover, they take down notes while someone is speaking. Taking down notes can sometimes distract the speakers attention, thus some speakers prefer to give handouts to allow the audience to respond well during a lecture. However, in the video clip, we see that by looking at the speaker while writing, the teachers are still able to maintain the rapport with each other. Therefore, the gesture of taking down notes does not affect the communication process in this particular situation. Although the teachers in the video clip demonstrate evidences for effective active listening, there remain some points to be improved. In particular, the participants who have shared their views could elicit the views of one speaker who did not talk. While it is commendable for the others, especially the teacher wearing a black blouse, to share their views, it would also help if they give a chance to the other participant who has not talked. Eliciting ones opinion or asking for clarifications (i. e. , asking, What do you think? ) can help detect signs of effective active listening. Through this, the speaker can check if the audience is truly listening. When the listener responds coherently to the speakers idea, we can note active listening signs. Otherwise, the speaker should find out factors that hinder effective active listening. Such factors may include outside noise, thoughts of the listener, or language barriers.

The Validity of Creationism and Evolution Essay -- Science Creationism

The Validity of Creationism and Evolution Abstract: This paper discusses the validity of both creation and evolution and examines whether they can interact with each other. Besides doing my own research, I have chosen to interview four people extensively involved in either Christianity or biology. I specifically picked interviewees who strongly supported either evolution or creation to get both sides of the issue. Two of the people were from United Christian Fellowship (UCF): Andrew Larratt-Smith, leader of UCF, and Ricardo Dawkins, UCF small group member. I also interviewed two biologists: Paul Matsudaira, MIT Biology professor, and Bettina Bauer, a post-doctoral fellow in the HST department. Paul considers his religious beliefs in between agnosticism and Catholic. He was baptized in the Roman Catholic church but has not thought about God extensively. Bettina is neither religious nor anti-religious. She says that if God really exists, it would not change her life. From these interviews, I hoped to gain a better understandi ng of creation and evolution and examine whether they can co-exist. Creationism is based on the belief that God is the intelligent Designer who created our universe and the natural things in it. It is derived from the two stories of Genesis. The first of the stories (Genesis 1:1-2:3) states that God created the heavens and the earth, light, water, vegetation, animals, and then man in the image of him. In the second account (2:4-2:9), God made the heavens and the earth, water, man from the dust, and then vegeta-tion and animals. Clearly these two accounts differ from each other in terms of order. The response I received from creationists (Andrew) was that the Bible must not always be taken literall... ...onists want to put the hand of God behind various scientific processes, scientists cannot show that they are incorrect. His reasoning is that religion is dogmatic and not scientific in its nature. In conclusion, history has shown that religion and science can interact, and that reli gion has adjusted to the renewing knowledge of science. Therefore, the claim that science and religion are in separate spheres is not solid reasoning to avoid interrelating the two. However, religion as a whole does not need to obey scientific laws, nor can it be proved through repeatable experiments. It may never be disproved by science because its strength is gathered from the faith of its followers. Hence when scientific theories such as evolution extend itself to answer questions of why humans were created and what began life, it will ultimately fail in its attempts.

Advocacy Campaign Essay

Abstract The purpose of this paper is to implement an advocacy campaign that will assist adults with disabilities with the necessary resources that will assist them in becoming productive citizens in the community. As children with disabilities, community- based support services are not available after he or she becomes an adult, consequently, there is no information provided to aid them with basic needs such as social empowerment, financial assistance, provision maintenance, and other agencies that will assist them and their families if needed. This paper will also discuss the goals, barriers, and support factors that will assist in this advocacy campaign, as well as the activities that will be implemented along with the necessary resources that are available for adults with disabilities. Introduction, Needs, and Goals A young child who is diagnosed with a disability, alter their familys lives forever. Dealing with the challenges from the disability, families had to rely upon strengths withi n themselves that they did not know existed. Community-based services for children with disabilities are available until the child reaches adulthood. After the child becomes an adult and wants to pursue a career, they have to pay for it themselves through financial aid or school loans that have to be repaid back once graduation is completed. Some people with a disability cannot drive therefore, it is difficult for them to get out and socialize so they remain confined to their homes without a support system. Advocating for people with disabilities will help them receive community resources as needed that will assist them with their advocacy needs. Disabled people face many challenges in society. There is a great need for advocacy when it comes to assisting these individuals with crises that affects their daily living. The purpose of this advocacy campaign is to educate disabled people and their families about the resources that are available to assist them with their basic advocacy needs. Knight and Oliver (2007) stressed that there is a demand for advocacy for children and young people with disabilities that have difficulty with m aking important decisions that will affect their lives. The basic needs that hinders individuals with disabilities live a  productive life in the community are (1) social empowerment (2) financial assistance for education, (3) provision maintenance, and (4) support systems. Empowerment is described as a person who cannot completely accomplish their goal and become a part of society and, if they are not able to have a say, and take control over their situations regarding their life (Miller, Hinterlong, Greene, 2010). People cannot completely accomplish their goal to be a part of society if they are not able to have a say and take control over their situations regarding their life. Houten and Jacobs (2005) stressed that empowerment cannot take place unless there is active participation in their community and society. However, active involvement of disabled people has not been clear in reality, it is difficult if we take a quick look at the living circumstances and the capability of disabled people. According to Voorhis and Hostetter (2006), social empowerment among social service professionals placed attention on the perception of empowerment among social service professionals, and their responsibility for client empowerment through advocacy. Financial as sistance for education to assist people with disabilities will help them further their education after undergraduate because financial aid is no longer available. Boone and King-Berry (2009) asserts that people with disabilities and their relatives have a serious need for information related in particular to their disability status. For example, they also mentioned that a financial incentive program that offer cash or other benefits should be created to increase more income, additional services, and or else an economic opportunity for individuals with disabilities. Providing financial assistance through community support will decrease the anxiety of them not being able to complete educational goals because lack of funds, and also stop them from applying for student loans that is repayable once they receive their degree. Provision maintenance is an ongoing service for individual with disabilities to help aid in housekeeping, laundry, and meal preparation on a regular basis when needed, not just when their impairment will not allow them to perform these daily functions, so they can continue to live independently. Provision maintenance will benef it them by providing them with a service that will complete those chores on the days they are not mobile because of pain. According to Moone and Lightfoot (2009), people with disabilities desire to live independently in the community and a need for  suitable services is needed that will support them with daily living. Support systems are essential to everyone, not just those with disabilities. However, individuals with disabilities depend on the aid of family, friends, and services within the community to assist them until they are totally dependent upon themselves. Support services for people with disabilities are vital to the achievement of students with disabilities (Tagayuna, Stodden, Chang, Zeleznik, Whelley, 2005). Professionals must also accept that they have a responsibility to work with and support the disabled persons family, because a person who places the family in danger, also places professionals in danger as well. Therefore, professionals must build relationships with families for personal growth and development by supporting people with disabilities. Van Haren and Fiedler (2008) convey that professionals must positive to make families not so dependent on their advice and services through a family empowerment plan. The goal of this advocacy campaign is to support individuals with disabilities by connecting them to community based services that will aid them in their pursuit to become a well-rounded individual, to collaborate with United Cerebral Palsy in assisting with this campaign for resources for people with disabilities. As Luecking and Wittenburg (2009) reveals, a system linkage is needed to provide services for people with disabilities whose service needs, and lack of contact to supports systems can cause difficulties in preparing for schooling, work, and independent living for people with disabilities. Barriers and Supports There are several potential barriers that may hinder this campaign applying resources to people with disabilities. They are (1) a need of financial assistance if people with disabilities want to pursue a career beyond undergraduate to relieve stress of not having enough funds to continue their education because the only funding that is available is student loans, whi ch will place this population in debt. Regardless of how much students and parents spend in the United States, such as credit cards, which shows lack of financing, over fifty percent of college students have accumulated over five thousand dollars in debt from a loan company like Sally Mae (Boone, King-Berry (2009). It is important to help these people with educational funding from community resource that will help them financially while continuing their education. Another potential barrier that may hinder this campaign of applying resources for disabled people is needs  for disable people to socialize within the community regardless of their handicap. It is difficult to socialize when a person is confined at home because of a disability. There should be a resource that provides people with disabilities to go and socialize with other people beside them that have a disability. According to Taub, McLorg and Bartnick (2009), there is a barrier called environmental, which get in the way of disabled women participating in soc ial activities because of the location of the activity. For example, a person in a wheelchair, there may not be enough space for it. The last potential barrier that may hinder this campaign of applying resources to disabled people is a need for the already existing community based services to work together and provide these clients with the necessary resources if needed. A person may believe that it would be simple for community-based services to work with a counselor to provide home health care for their disabled client on an ongoing temporary basis to assist him or her with personal and home care needs per their request. On the other hand, some community base services do not provide that type of home health care. Singer, Biegel, and Ethridge (2009) support this barrier by asserting that care giving is not needed for a few weeks or months during a loved ones acute illness, instead the need for assistance with daily living commonly last for years (p. 101). Even though there are several barriers that may hinder the advocacy campaign for helping disabled people, but there are various support factors that will assist with the efforts of this campaign such as non-profit organizations, home health care, state legislatures and elected representatives. Non-profit organizations. Home health care is needed for people with disabilities to assist them with pers onal care and household chores when their mobility has decreased due to the pain from the condition when it occurs, not always because they may not be in pain on a daily basis. Therefore, there should be organizations and federal and legislatures that work together to assist these people with their personal care needs like maxim health care (www.maximhealthcare.com), which is a non-profit organization that will collaborate with other organizations and federal, state, and local policies that will help aid in the advocacy effort for these people (Wehrwein, Pollack, 2005). Activities Problem Definition Since the problem definition has been described that will advocate change a proposed campaign will be developed (Rothstein, 2008). After that,  it is necessary to research of the resources for advocating for disabled people that have access to that will help in their campaign. A resource will include centers for people with disability and the people who need information on the necessary resources these advocacy needs. Next, developing the advocacy campaign for disabled people will include finding volunteers, creating the vision and mission statement, leadershi p team, fundraisers or sponsors that will provide monetary resources, and the results of the campaign. The volunteers will consist of skillful advocates who have years of experience that is elected and appointed leaders that will work for the cause of this campaign (Donaldson, 2008). For example, the president, the vice president, secretary, treasurer, and the Chaplin. The vision and mission statement will be created from the consumer education from the issues researched for this campaign for people with disabilities. The leadership team will consist community leaders that are strong, effective, and organizers (Keys, Factors, 2001). The leadership team will be committed and knowledgeable in the issues that people with disabilities encounter. The committee will also consist people who will locate sponsors or create fundraisers to provide funds for this campaign. The results of the campaign will be the resources that will enable people with disabilities to receive services to assist them with becoming active citizens within the community, finances for school, home health care that will assist them with personal care and household chores when need, and support system that will help them and their families become independent on making their own decisions. Strategic P lanning This process will be developed from social marketing strategies for reaching people with disabilities. Social marketing is characterized as marketing techniques that will be used to gear skillful people in the area of disabilities to promote change for action (Moone, Lightfoot, 2009). For example, the planning will be created through social marketing strategies to support individuals with disabilities by connecting them to the community- based services that will aid them in their pursuit to become active citizens in the community. When advocating for people with disabilities, this type of strategy will benefit because it will focus on what the disable person need, such as social empowerment and finances to further education rather than focusing on the disability (Moone, Lightfoot, 2009). The six marketing are (1) participants, which is the people that will  focus on the needs of the disabled people (2) partnering with other agencies that will work with disabled people, this technique is essential to the campaign (3) price, getting the federal, state, and legislators to act on behalf of the disabled people (4) promotion, is the materials that will be used to get the information in the community (5) product, advocating for people with disabilities to receive the n ecessary resources for their basic needs and (6) place, is where the campaign advocates will meet within the community to provide services (Moone, Lightfoot, 2009). Actions This stage of the advocacy campaign for people with disabilities who will make contact with the people that are in the public eye such as the city officials to support the advocacy efforts on behalf of disabled people, which Eriksen (1997) characterize as lobbying. Then that person or organization must review the information from research to decide whether lobbying will be suitable advocate that will take action through communicating the organizations needs to such as agencies that provide financial assistance, home health care providers, and support systems such as United Cerebral Palsy through letters, flyers, phone calls to officials to support laws on research for resources in aiding disabled people, support groups for disabled people, and networking are beneficial to advocating for people with disabilities. This process will provide positive point of views on advocacy and support advocates that will act on behalf of disabled people (Toporek, Lewis, Crethar, 2009). Evaluations Evaluation of the advocacy campaign is vital in any organization to ensure that there are no problems that are not identified such as environmental problems, financial problems, attitudinal problems, and problems with the group that might affect the completion of the advocacy campaign (Torres, Preskill, 2001). To ensure that the evaluation of the advocacy campaign is successful in advocating on behalf of the client, the advocate leader will utilize SPIES, which is categorized as strategic planning, implementation, evaluating, and streamlining (www.courseroom2.capella.edu). Once the mission and the rationale has been established, the advocacy committee must strategize a plan along with the disabled clients to implement the goals that is aim to aid people with disabilities connect to community resources to assist in their advocacy efforts. The disabled person will have to make a decision to become a self-advocate to assist the counselor in fighting for resources to aid them  with funds for education, home health aide, and a support system that will help him or her become active people in the community. After the plan have been developed, then the implementation of the activity can be set up by allowing the client to speak at a workshop on his or her behalf about funding for education, and then evaluate by doing follow-up on him or her to see if the plan is being completed. Finally, the counselor would streamline by providing disabled people with support groups for disabled people who are having a difficult time receiving resources that will help them w ith their advocacy efforts to observe other in similar situations and help them make a decision to continue to plead for their own cause. The advocacy meetings will take place in the local library on every Wednesday of the month. There will be approximately three new volunteer members will be assigned per month as needed for campaign. Each member will be assigned four disabled clients and their family members and provide information as to whether they already receive community-based services. Counselor Roles in the Advocacy Campaign The counselor that will be advocating in the campaign for disabled people is trained in professional counseling so he or she can intervene with these clients individually or in a group in order to understand the clients disability as well as the advocacy efforts (Kiselica , Robinson, 2001). He or she will beware of their own values, skills, and personalities that are vital to advocacy, which will consist of relationship building and communications skills to effective plead the advocacy efforts to the community clearly so he or she can be heard. He or she is a good listener, seek questions to understand the needs of the client, they will portray good character and integrity that is trustworthy as well as have the ability to think normally so they can plan the best strategy for this disabled people (Eriksen, 1997). He or she will show commitment and appreciation for their clients (Kiselica, Robinson, 2001). For example, the advocate counselor wi ll ensure that the disabled client know that they understand and feel what they are experiencing and will do everything to assist them in receiving the necessary resources that will enable them to become sociable in the community, funds to continue their education, aid with household chores, and support systems that will support their needs. The advocate must be knowledgeable in communications skills such as verbal and nonverbal and realize what the client is saying and not saying. He or she should also be  able to speak with any organization that will aid in helping the disabled clients live productively by utilizing their skills in the areas of being able to discuss complicated problems with the clients such as not being able to provide home health care because of the severity of the condition, using the computer to obtain research on disability as it relates to the advocacy campaign, must be able to communicate the advocacy efforts through television or radio (Kiselica and Robinson (2001). These skills are necessary for advocacy work. The counselor has developed many relationships throughout his or her field of counseling. He or she is involved in professional organizations, assisted other organizations that are already involved in activities that already in existence in the community, and no doubt has been involved in legislation in some way. In other words, the counselor is the best advocate for advocating for this disabled people because he or she already possesses the skills that will make this grass root campaign into a reality. However, with any advocacy campaign there are ethical issues that may arise while planning a strategy. In planning for this campaign, the counselor did not consider that there may be some barriers that may hinder the personal growth and development of the disabled client while working on this campaign (Greenleaf, Williams 2009). The ethical dilemmas that may arise in advocating for disabled people to receive community resources such as being mindful of the power relationship between the counselor and the client, by not letting the client gain control over the interview by speaking on behalf of himself or herself (Knight, Oliver, 2007). For example, not gaining information about the clients disability before the interview, learn their behaviors because there may be some type of concern that they may not be able to complete the interview and counselor-client relationship by overstepping his or her by getting overly involved with the clients problems. Kiselica and Robinson (2001) assert that professionals must describe the boundaries of their relationships with clients even if they take on a more involved role than they are responsible for. For example, a counselor that is disabled may become to involved with the clients situation and make all the decisions the planning stage because they have experienced similar advocacy efforts of the client regardless of what cultural background the disabled client are from, the counselor must let the disabled client become a productive citizens by letting him or her  make their own decision for improving change through community based services. Resources There will be a list of local and systematic resources that will be used in collaboration with the advocacy campaign for disabled people to provide community based services that will assist them in locating social activities within the community to become active, funding for college to continue their education, agencies to assist them with provision maintenance, and support system that will help them and their family to become independent and work on their own behalf. (See Appendix). Finite Verb Definition and Examples In English grammar, a finite verb is a form of a  verb  that (a) shows  agreement  with a  subject  and (b) is marked for  tense. Nonfinite verbs  are not marked for tense and do not show agreement with a subject. If there is just one verb in a sentence, that  verb is finite. (Put another way, a finite verb  can stand by itself in a sentence.)  Finite verbs are sometimes called main verbs or tensed verbs.  A  finite  clause  is a word group that contains a finite verb form as its central element. In An Introduction to Word Grammar, Richard Hudson writes: The reason  finite verbs  are so important is their unique ability to act as the sentence-root. They can be used as the only verb in the sentence, whereas all the others have to depend on some other word, so finite verbs really stand out. Finite vs. Nonfinite Verbs The main difference between finite verbs and nonfinite verbs is that the former can act as the root of an independent clause, or a full sentence, while the latter cannot. For example, take the following sentence: The man runs to the store to get a gallon of milk. Runs is a finite verb because it agrees with the subject (man) and because it marks the tense (present tense). Get is a nonfinite verb because it does not agree with the subject or mark the tense. Rather, it is an infinitive and depends on the main verb runs. By simplifying this sentence, we can see that runs has the ability to act as the root of an independent clause: The man runs to the store. Nonfinite verbs take three different forms- the infinitive, the participle, or the gerund. The infinitive form of a verb (such as to get in the example above) is also known as the base form, and is often introduced by a main verb and the word to, as in this sentence: He wanted to find a solution. The participle form appears when the perfect or progressive tense is used, as in this  sentence: He is looking for a solution. Finally, the gerund form appears when the verb is treated as an object or subject, as in this  sentence: Looking for solutions is something he enjoys. Root Causes of Accidents on Construction The construction industry is one of the biggest industries in the whole world. The contribution of this industry towards the global GDP is enormous. The construction industry is also a potential employment generator and employs large number of skilled and unskilled labors. In UK the construction industry employs more than 2.1 million people and accounts for around 9% of the total employment within UK (Howarth and Watson., 2009). Since the industry employs large number, it also has a significant impact on the health and safety of the people working in it. The process of construction involves various activities such as working at heights, working in confined spaces, manual handling, lifting operations, demolition works and ground works. These all activities involve risks and are very hazardous in nature, so the chances of accidents taking place on construction sites are high. Now in order to reduce the level of risk it is very important to implement proper safety management systems on construction sites. The UK construction industry is successful in many respects. The construction industry in UK has shown a steady improvement in the safety performance after the Egan Report (1998) but still faces numerous challenges with regard to safety on its journey to improve its performance record whilst delivering increased volume and complex construction projects (Howarth and Watson., 2009). According to HSE statistics, more than 200 people are killed at work in United Kingdom every year excluding work related road accidents. In 2006, 30 million working days was lost in UK to occupational ill health and injury which imposed an annual cost of  £30 billion i.e. more than 3% of GDP. As per Lingard and Rowlinson (2005), the construction industry consists of several SMEs and small amount of large firms. These small and medium size firms lack knowledge and resources required to implement safety management activities so the issues related to health and safety are more in small and medium size firms. Eakins (1992)stated that international research confirms that the issues related to health and safety are more in SMEs as compared to larger firms and also smaller firms are poor in implementation of safety programmes. Therefore smaller firms have higher injury frequency rates as compared to larger firms. The Company- Millennium Contractors Ltd. Millennium Contractors Ltd. is a small and medium size firm which has been working in the UK construction industry for the last 25 years. The company has a much diversified work force, employees from different cultural background and of different age group works in the company. Diversity in construction organizations in terms of culture and ethnicity has many advantages but at the same time there are many disadvantages related to it. In the condition of uncertainty and complexity diversity does not fare well which may lead to confusion and frustration. In a multicultural organization it is very hard to arrive at an agreement on a particular course of action, and can result in negative dynamics and cultural clashes. The other main disadvantage of multicultural organization is the lack of coordination and communication between the workers which can be a contributing cause of an accident. Apart from this the company is committed to prevention of injuries and ill health at work place but has failed in promoting an incident injury free culture. The recent record of the company related to health and safety has not been very good. There have been many accidents which included one fatal accident resulting from the fall from height and other major/minor injuries and also some incidents of dangerous occurrences. The main areas of concern for the company have been; manual handling; hit by falling objects; hit by moving vehicles; collapse of temporary structures and scaffoldings. The company was also served with a prohibition notice because of a fatal injury caused by falling from mobile elevated working platform. The companys policy towards health and safety is also not up to mark. The management has been irresponsible in implementing the policies in an organized manner, which has contributed to the main cause of accident. According to Baxendale and Jones as cited in (Kashyap et al., 2005), the majority of the accidents are not caused by the carelessness of the worker but by the negligence or by the failure to control by the management. Moreover the management should be able to judge the capabilities of the employee before allocating the job and the employees in response should be capable of doing the allocated work. Hence with an involved and committed staff a positive health and safety culture can be maintained. According to Cooper (1998), the impact of organizational safety culture not only affects the accident rates but has significant impact on work methods, absenteeism, quality, commitment, loyalty and satisfaction. According to HSE the positive health and safety culture can only be ach ieved through 4Cs; competence- recruitment, training and advisory support; control- allocating responsibility, commitment, instruction and supervision; co-operation- between individual and group; communication- spoken, written and visible (Clarke, 1999). Issues related to Health and safety in Millennium Contractors Limited As mentioned above, the company has failed to implement structured policy towards health and safety, as a result of which there has been regular incidents of dangerous occurrences. The common issues that the company is facing regularly and the legal action that could be taken against the company are as follows. Manual handling The manual handling regulations (1992) defines manual handling as any transporting or supporting of a load (including the lifting, putting down, pushing, pulling, carrying or moving thereof) by hand or by bodily force. In effect, any activity that requires an individual to lift, move or support a load is classified as manual handling operations (Stranks, 2006). Manual material handling is one of the most significant risk factors for back problems, whole body vibration, bent and twisted positions (Roy et al., 1999). If proper safety measures are not involved while manual handling of materials, it may lead to injuries and occupational diseases. According to HSE, manual handling injuries are the most common type of occupational ill health in UK. As per Helander (1991), 15% of the back injuries due to manual material handling occur in the construction industry. The main causes of incidents due to manual handling were; The use of poor techniques to move materials. Lack of proper training and guidelines provided to the workers by the management. Lack of communication and co-operation among the workers. The above figure shows the proper method of moving and lifting materials which can be very effective in reducing the injuries caused by manual handling of materials. Legal aspects related to manual handling; Section 2 of the Health and Safety at Work Act 1974 and regulations 10 and 13 of the Management of Health and Safety at Work Regulations 1999 states that it is the duty of employers to provide their employees with health and safety information and training. This should be supplemented as necessary with more specific information and training on manual handling injury risks and prevention, as part of the steps to reduce risk required by regulation 4(1)(b)(ii) of the Regulations (HSE). Hit by Falling Object The other main issue faced by the company is hit by falling objects. The small objects like bricks, hammers, nails and tiles when dropped from the height can cause fatal head injuries and other serious injuries to the worker working below it or any other person passing by it as shown in the figure. The main causes of this type of injury were; Poor standards of housekeeping. Failure of management in providing safety nets at heights. Inadequate project planning which leads to inadequate storage of materials. Lack of proper guidelines provided to the workers working at height. Absence of cautionary sign boards. Legal aspects related to hit from the falling object; Regulation 8(b) part 1 of schedule 3, of the Work at Height Regulation, 2005, states that it is the duty of the employer to prevent, where necessary, injury to any person so far as reasonably practicable and also the employer shall provide enough storage space so as to prevent risk of movement of such material. Fall from height The company has a record of one fatal accident resulting from the fall from height. According to the data of HSE in 2005/06 falls from height accounted for 46 fatal accidents at work and around 3350 major injuries. This was the single biggest cause of workplace deaths and one of the main causes of major injury. The workers working at heights are prone to have fatal injuries such as skull fractures. Therefore it is absolutely necessary to provide proper training and guidance to the workers working at height. The main causes of this type of incident were; Lack of proper training and guidelines provided to worker by the management. Negligence and unsafe action of the worker. Inadequate use of personal protective equipments. Lack of planning and supervision. No barrication provided. Legal aspects related to fall from height; The Work at Height Regulation 2005 applies to all work at height where there is a risk of fall liable to cause personal injury. It place duties on workers, employers, the self-employed, and any person who controls the work of others (eg facilities managers or building owners who may contract others to work at height) to the extent they control the work. Hit by moving vehicle The other issue of the company is workers being hit by moving vehicles. This type of issues is very dangerous in occurrence and can cause fatal injury. The accident involved vehicle like trucks. The main causes of this type of incident were; Inadequate site planning Improper signs and absence of cautionary (speed limit) boards Unsafe conditions of working Legal aspect related to hit by the moving vehicle; Section 2(2)(a) of HSWA 1974 states that it is responsibility of the employer to maintain plant and system at workplace, so far as is reasonably practicable. According to Workplace (Health, Safety and Welfare) Regulation (17), there should efficient segregation of pedestrian from vehicular traffic of incoming and outgoing. Collapse of temporary structures and scaffolding The other main issue of the company related to health and safety was collapse of temporary structures and scaffoldings. The incident took place due to lack of inspection. Incompetence of the inspectors to identify risk and hazard involved. Moreover the employer failed to provide the workers with suitable equipment and provide collective measures along with personal protective measures. Legal Aspect: The Work at Height Regulation 2005, Regulation6(4)(b), 6(5)(a,b), 7, 8, 12 and 13, states that it is necessary for the employer to provide suitable equipment, take account of working condition and rigorous inspection by a competent person. Further according to section 2(2)(a) of HSWA 1974, there should be provision and maintenance of plant and machinery at work. Apart from these issues the company was served with three enforcement notices and one prohibition notice by HSE because of dangerous occurrences at work place. The company failed to implement proper structure of health and safety policy due to inadequate management system. Hence for successful implementation of the policy the company should have proper safety management system. Safety Management aims at minimizing the chances of risks, injuries and accidents by implementing risk management techniques and safety management operations, improving the standard of health of the employees, monitoring the operating systems and bolstering the safety measures of an organization. Management practices and documentation In order to reduce the risks of accidents in the company the company should have proper management practices and associated documentation relating to safety induction procedures, tool-box talks, training requirement, accident record book and method statements. The proper safe management practices involve; Risk assessment: During risk assessment, the hazards or hazardous work is first identified before commencement of any work activity. The rating information is then passed on for preparation of method statement, which must be read and understood by every worker undertaking the activity before the commencement of work. Method statement: It is the document that shows or states how an activity needs to be carried out in a safe manner. The statement is usually prepared by a competent person and passed to the principle contractor and the safety coordinator for its inclusion in sites health and safety plan. Site induction and training: The site induction and training is usually provided to the worker before the start of any work by the employer. The workers are informed about the various precautions that are to be taken while working on sites. The site induction includes brief on welfare facilities, brief on site hazards, brief on how to report onsite injury or accidents and the use of PPEs. Accident record book: The accidents that take place on sites are to be entered in this book. Any reportable accident should be reported under RIDDOR, to the site supervisor immediately. Tool box talks: Toolbox  talks  are safety lectures aimed at the construction trade. The lectures are intended to educate workers about creating and maintaining safer work conditions, and attendance is mandatory with many companies. Many companies provide toolbox  talks  in modular form, so that a safety educator has a  curriculum  readily available. The Millennium Contractors Ltd do not have organized structure of management and have failed in implementing the health and safety polices due to which the company is unable to follow safe management practices. Overcoming the Barriers The potential barriers that the company needs to overcome to aim for zero accident policy on sites are as follows; Cultural and language barrier: The company has mixed workforce, workers from different cultural background works in the company now because of ethnic diversity the management might find it difficult to convey all the messages efficiently, resulting in difference in understanding of instructions which may cause problems regarding safety on sites. Fear of change: New ways and methods of working may create confusion and sense of uncomforting amongst workers, leading them to traditional ways of working which can cause some problems related to safety. Therefore in order to overcome this barrier the company should motivate the workers and should train them properly. Difference in education level: Different workers might have studied till different levels in education. It may affect their ability to understand instructions clearly. Conclusion Although the company has vast experience it had failed in implementing the safety policies which are very essential for reducing the risks of accidents. The company has inadequate safety management system which has resulted in several major and minor incidents. An effective safety management system will be most effective if a safety culture permeates the organization and this can only be achieved through communicating leadership, personalizing safety outcomes, engaging individuals in safety responsibilities, improving understanding of safety system and increasing hazard/risk awareness and preventive behaviors. In order to improve the safety management system the Millennium Contractors Ltd must follow these steps which would indirectly help them in reducing the accidents.

It has come to my attention that our wonderful state has done something terrible. That something is the allowance of abortions. What is an abortion you might ask? Well it is the termination of a pregnancy, or the killing of a baby, to be simply put. This issue has split our country for years, and I think that we as a state should step and make an example to the rest of the world and stop abortions.   Ã‚  Ã‚  Ã‚  Ã‚  It is nearly impossible anymore to find someone who doesn’t have an opinion about abortion. Yet the endless debates on the topic usually go nowhere, leaving the opponents even more stuck to their positions, and the open-minded observers even more confused, but both sides have a good case. For example an unwanted child is a pitiful thing, and the apparent social problems like child neglect, and financial burden that comes with it don’t have easy solutions. On the other hand, the thought of killing a little baby is disgusting and unthinkable.   Ã‚  Ã‚  Ã‚  Ã‚   This is where I stand, and the only solution I can come up with is the total ban of abortions altogether. This task should not be a hard one, but it might take some time. My plan calls for the closing and the illegalizing of abortion clinics, and the prosecution of people who perform these deeds.   Ã‚  Ã‚  Ã‚  Ã‚  As with any big descion we must consider the opposing views. One reason that the debate on what we should do about abortions doesn’t go anywhere, is because each side focuses on a different topic. We make no progress because we are not talking about the same thing. The anti-abortionists are focused on the fetus’ rights, and the pro-abortionists are focused on the women’s rights. Though these issues are basically interrelated, they are different topics.   Ã‚  Ã‚  Ã‚  Ã‚   The issues of the social problems like child neglect and financial burden, and even the issue that it is the woman’s exclusive right to make decisions concerning her body; they are not the problem. It all comes down to one thing: Is the fetus a person? That is the issue that cannot be agreed upon. Medical science has overwhelmingly demonstrated that biological life begins at conception. Furthermore, the developing embryo isn’t simply part of the mother, it’s a separate being that just inhabits the mother.

Justification of Punishment ABSTRACT: Both utilitarians and the deontologists are of the opinion that punishment is justifiable, but according to the utilitarian moral thinkers, punishment can be justified solely by its consequences, while the deontologists believe that punishment is justifiable purely on retributive ground. D. D. Raphael is found to reconcile both views. According to him, a punishment is justified when it is both useful and deserved. Maclagan, on the other hand, denies it to be justifiable in the sense that it is not right to punish an offender. I claim that punishment is not justifiable but not in the sense in which it is claimed by Maclagan. The aim of this paper is to prove the absurdity of the enquiry as to whether punishment can be justified. Difference results from differing interpretations of the term 'justification.' In its traditional meaning, justification can hardly be distinguished from evaluation. In this sense, to justify an act is to say that it is good or right. I differ from t he traditional use and insist that no act or conduct can be justified. Infliction of punishment is a human conduct and as such it is absurd to ask for its justification. I hold the view that to justify is to give reason, and it is only a statement or an assertion behind which we can put forth reason. Infliction of pain is an act behind which the agent may have purpose or intention but not reason. So, it is not punishment, but rather statements concerning punishment that we can justify. Regarding the justification of punishment philosophers are not of the same opinion. According to the utilitarian moral thinkers punishment can be justified solely by its consequences. That is to say, according to the utilitarian account of punishment 'A ought to be punished' means that A has done an act harmful to people and it needs to be prevented by punishment or the threat of it. So, it will be useful to punish A. Deontologists like Mabbott, Ewing and Hawkins, on the other hand, believe that punishment is justifiable purely on retributive grounds. That is to say, according to them, only the past fact that a man has committed a crime is sufficient enough to justify the punishment inflicted on him. But D.D. Raphael is found to reconcile between the two opposite views. According to him, a punishment is justified when it is both useful and deserved.

A Citizen’s Guide to American Ideology: Conservatism and Liberalism in Contemporary Politics Essay

Conservatism is political belief based on social stability and tradition, emphasizing established institutions and having a preference on a gradual development to an abrupt change (Marietta 23). In conservative theories, they aim to preserve and restore, stressing continuity and stability, limit to change, restricted government guidelines of business and strong national defenses (Para 3). Conservatism so to speak is political morality. Conservative political drives have been productive as they have unified people of different opinions on the basis of shared goals (Mannheim 41).It is not possible to find the successes of conservatism in a big government but through individual achievement and freedom! According to O’hara, conservative ideology is mirrored through family values, decent parenting at home and what can be achieved when the government ceases to interfere (52). For instance, set of grandparents living their years without debt with their families leading a simple but self-governing life and out of trouble that’s a conservative success. When a small business opens up, with owners working hard and selling authentic products and excellent service, then gradually expanding step by step then becoming a big business organization†¦that is a conservative success story. If you see a soldier risking his life to protect the inhabitants of a dangerous area and receiving no recognition, that is conser vative values in action (Cecil 23). Conservative form of leadership is the best, as it grows people to take responsibility for their actions, health, education and family the success is revealed in the glory and accomplishments of the individual and not in the credit and achievement of legislation that will promise some things that one should earn on their own. In Canada, the Harper government has offered positive differences to the people of Canada and the world in general. It has offered tax relief with a 2% decrease to 5% in goods and services tax (GST), has assisted working families by lowering income taxes, has lowered small business and corporate taxes and has introduced the universal child care benefit that has given families real choices in child care (Gottfried 45). The harper government has also taken action by offering a special tax credits which has assisted in paying for children’s fitness programme, in regard to Crime and Justice, it has improved with strong new laws and punishments that fit the crime. The Tackling Violent Crime Act has ensured that criminals who get jail condemnations pay their dues to the society. According to Gottfried, corporations and unions have been banned from contributing to politics (66); the amount that an individual can donate has been reduced to between $5,000 and $1,100 per year. There has also been investment in the Canadian Forces who strive to protect the country and its citizens by providing insurance for the personnel, while increasing sustenance for those who experience injury and illness in the line of duty. Canada signed the Copenhagen According, an agreement among developing and developed nations to decrease the worldwide level of air pollution ( Viereck and Claus 33). In America, during the president George W. Bush conservative administration, they never accepted corruption in office and rejected the state ordering people how they should lead their lives. In 2007 President Bush lifted the strategy for the war in Iraq from forced safeguarding to population security (Marrieta 54). In 2002, President Bush fronted the â€Å"housing first† strategy to reduce homelessness this worked and the number of homeless people decreased by 30 percent between 2005 and 2007. According to Marrieta, he addressed nationwide poverty, increased financial aid to developing countries and assisted in alleviating AIDS in Africa (67). The Howard government’s policies enabled the provision of low rates of interest, lower taxation and increased economic growth; Australian domestic students by allowing them to invest in their own education, increased total revenue for higher education institutions from $8.6 billion in 1997 to $16.8 billion in 2007( O’hara 46) Conclusion The principles of conservatism are all-encompassing as they are founded on what men and women have learned through involvement in a dozen generations. With all the experience of the past and present, conservative future is still going to continue working as the task will not be to sell a philosophy, but to make the citizens, who already believe in the philosophy, see that modern conservatism offers us a political home (Marietta 27).From above it evident that conservatism prevents movement backward and downward and towards forward and upward away from chaotic darkness and primitive state, a philosophy that world nations should adopt for better and brighter futures. There are people that instead of going to the market to get food, they prefer to order groceries online to get it delivered home. When it comes to education, some students just search for the easy answers available online, instead of taking the time to do the research.
